  • It depends! But, usually it’s not the passenger. Fault could fall on the driver of the Uber or Lyft you’re riding in if they are the one performing negligent or illegal traffic activity. If you’re in a rideshare, are hit by another driver, and the Uber/Lyft driver is obeying all traffic laws then it’s likely the other driver is at fault.
